Terms of Service - Datacenter Broker

1. Definitions

1.1 Service Provider: Datacenter Broker, located in Amsterdam, The Netherlands.
1.2 Client: The natural or legal person using Datacenter Broker's services.
1.3 Services: The brokerage of suitable datacenter colocation solutions.
1.4 Datacenter: A third party providing colocation services.

2. Applicability

2.1 These terms and conditions apply to all offers, agreements, and services of Datacenter Broker. 2.2 Deviations from these terms are only valid if agreed upon in writing.

3. Services

3.1 Datacenter Broker acts as an intermediary between the Client and datacenters. 3.2 Datacenter Broker does not guarantee the availability of specific datacenter facilities. 3.3 The final agreement for colocation services is concluded between the Client and the datacenter.

4. Fees

4.1 The brokerage fee is agreed upon with the Client in advance. 4.2 Rates are exclusive of VAT unless stated otherwise. 4.3 Payment term is 30 days after invoice date.

5. Liability

5.1 Datacenter Broker is not liable for the services provided by the datacenters. 5.2 Maximum liability is limited to the amount of the brokerage fee. 5.3 Datacenter Broker is not liable for indirect damages.

6. Confidentiality

6.1 Parties commit to maintaining confidentiality of confidential information. 6.2 This obligation remains in effect after termination of the agreement.
